Procedural Posture

Stay Application / Ruling on Application for Stay of Proceedings Pending Appeal

  1. 1 Whether the applicant is entitled to an order for stay of further proceedings pending appeal.
  2. 2 Whether the application for stay was brought under the correct legal provision.
  3. 3 Whether the applicant has demonstrated compliance with the procedural requirements for filing an appeal.

Ratio Decidendi

The court found that although the applicant filed a notice of appeal within the prescribed time, he failed to file a substantive appeal or obtain and serve a certificate of delay as required by the Court of Appeal Rules. The 60-day period for lodging the appeal had lapsed, and there was no evidence of any extension sought or granted. Consequently, the notice of appeal was deemed withdrawn under Rule 83, and there was no competent appeal before the court. The application for stay of proceedings was therefore without basis, and the court struck out the motion with costs to the respondents.
