The High Court found that the sum of Kshs. 1,435,681.91 awarded to the respondent was a liquidated amount, as it was specifically pleaded and proved as the respondent's contributions plus agreed interest under the insurance policy. The trial court erred by failing to specify the date from which interest would accrue on this sum. According to Section 26(1) and (2) of the Civil Procedure Act and established case law, interest on such a liquidated sum should accrue from the date of filing the suit, not from the date of judgment.
