Ratio Decidendi

The Court found that the applicant had demonstrated an arguable appeal, particularly on the issue of whether the quantum of damages awarded was excessive. The Court further held that if stay was not granted, the appeal could be rendered nugatory since the respondent might not be able to refund the sum already paid should the appeal succeed. The Court was satisfied that the balance of the judgment sum was adequately secured by a bank guarantee, and the respondent would suffer no prejudice if stay was granted. Accordingly, the Court exercised its discretion to grant a stay of execution pending the hearing and determination of the appeal.
