Procedural Posture

Environment and Land Appeal / Ruling on Contempt Application

  1. 1 Whether the appellants disobeyed valid court orders amounting to contempt of court.
  2. 2 Whether the application for contempt is merited in light of the lapse of stay orders.
  3. 3 Who should bear the costs of the application.

Ratio Decidendi

The court found that the stay orders granted on 10th May 2022 lapsed automatically after 60 days due to the applicants' failure to file and serve the Record of Appeal within the stipulated period. The Court of Appeal, when approached, allowed the filing of the appeal out of time but did not reinstate or extend the lapsed stay orders. Consequently, at the time of the alleged contempt, there was no valid or operative court order in force that the respondents could have disobeyed. The essential elements required to establish contempt—existence of a valid order, knowledge, and willful disobedience—were not satisfied. The application for contempt was therefore without merit and was dismissed...
