Ratio Decidendi

The court found that the applicants, having lived on the suit land for over 30 years and established their homes there, would suffer substantial loss if stay was not granted. The application was filed within a reasonable time after judgment. The court was satisfied that the requirements of Order 42 Rule 6(2) were met, including the risk of the appeal being rendered nugatory if execution proceeded. The court exercised its discretion to grant a stay of execution pending appeal, subject to the applicants formally filing and serving the appeal within sixty days, failing which the stay would lapse automatically. Costs of the application were ordered to abide by the outcome of the appeal.
