Civil Appeal / Ruling on Preliminary Objection

  1. 1 Whether the High Court has jurisdiction to hear an appeal involving an employment-related injury claim filed before the promulgation of the 2010 Constitution and before the establishment of the Employment and Labour Relations Court.
  2. 2 Whether a tortious claim arising from an employment relationship falls within the exclusive jurisdiction of the Employment and Labour Relations Court under Article 162(2)(a) of the Constitution and Section 12 of the Industrial Court Act, 2011.
  3. 3 Whether the objection to jurisdiction was raised at the earliest opportunity as required by law.

Furthermore, the issue of jurisdiction was not raised at the earliest opportunity, as required by law, and was not included in the memorandum of appeal or submissions prior to directions being given....
