Criminal Revision / Ruling on Application for Sentence Review

  1. 1 Whether the default sentence of four years' imprisonment imposed in lieu of payment of fine was lawful under the Penal Code.
  2. 2 Whether the applicant, having served more than the lawful default sentence, should be released immediately.

Ratio Decidendi

The court found that while the trial magistrate had discretion to impose a fine of KShs.500,000, the imposition of a four-year default custodial sentence was unlawful because Section 28(2) of the Penal Code limits the default sentence for fines above KShs.50,000 to a maximum of twelve months. Since the applicant had already served more than twelve months in custody, the court held that he should not remain in prison any longer and ordered his immediate release unless otherwise lawfully held.

Orders

  • The default sentence of four years' imprisonment is set aside and substituted with a term of twelve months' imprisonment.
  • The applicant is to be released forthwith unless otherwise lawfully held.
