Ratio Decidendi

The Court of Appeal found that while the intended appeal was arguable, the applicant failed to demonstrate that the appeal would be rendered nugatory if the injunction was not granted. The applicant had never been in possession of the property, did not show that the property was in danger of being disposed of, and did not establish that damages would not be an adequate remedy should he succeed in his claim. There was also no evidence that the respondent would be unable to pay damages. Accordingly, the Court was not satisfied that the circumstances justified the grant of an injunction pending appeal.
