The court found that the Plaintiffs' failure to annex or specifically refer to the timeshare contracts in the sale agreement of 20th January 2014, and the lack of evidence that the Defendant was made aware of the extent of timeshare encumbrances, raised a triable issue as to whether the Plaintiffs fulfilled their obligations under the contract.
