Procedural Posture

Civil Suit / Ruling on Application to Set Aside Injunction

  1. 1 Whether the injunction granted on 13th May 2011 should be set aside as it affected parties not before the court.
  2. 2 Whether the plaintiff complied with Order 1 Rule 8 of the Civil Procedure Rules regarding representative suits.
  3. 3 Whether the rights of third parties who acquired land titles were infringed by the injunction.

Ratio Decidendi

The court found that the plaintiff did not obtain leave to bring a representative action as required by Order 1 Rule 8 of the Civil Procedure Rules, and no directions were given for notifying the 3,777 persons whose titles were challenged. As a result, the injunction granted on 13th May 2011 affected persons who were not parties to the suit and had no notice of the proceedings, infringing their rights. The court held that sustaining the injunction would cause hardship to innocent third parties and was not legally sustainable. Accordingly, the court exercised its discretion under Order 40 Rule 7 to set aside and vacate the injunction order, declaring it of no legal effect.
