The court found that the plaintiffs' suit, whether premised on fraud or recovery of land, was statute barred. The evidence showed the plaintiffs (and their predecessor) were aware of the alleged fraudulent transfer and registration of the suit property as early as 2001. Under Section 4(2) of the Limitation of Actions Act, any action based on fraud should have been filed within three years of discovery, and under Section 7, any action for recovery of land within twelve years.
