Miscellaneous Application / Ruling on Application for Leave to File Suit Out of Time

  1. 1 Whether the applicant should be granted leave to file suit against the respondents after the limitation period has lapsed.
  2. 2 Whether Section 27 and 28 of the Limitation of Actions Act permit extension of time for employment claims.
  3. 3 Whether the delay in filing suit was justified.

Ratio Decidendi

The court found that the cause of action arose on May 28, 2007, prior to the commencement of the Employment Act, 2007, and was therefore governed by the Limitation of Actions Act, Cap 22. Under this Act, claims based on employment contracts must be filed within six years from the date the cause of action arose. The court held that Sections 27 and 28 of the Limitation of Actions Act do not permit extension of time for contract claims, including employment disputes. The applicant's delay in filing suit was not justified under the law, and the application for leave to file suit out of time was therefore dismissed. The court directed that the suit be heard on its merits without further delay.
