Ratio Decidendi

The court found that the two-month delay in filing the application was not inordinate and exercised its discretion to enlarge time for filing the appeal. On the issue of stay of execution, the court held that the applicants would suffer substantial prejudice if stay was not granted and the decretal sum was paid out and not recoverable should the appeal succeed. The court granted stay of execution on condition that the applicants pay part of the decretal amount (Kshs. 90,000) to the respondent within 45 days, finding this to be sufficient security. Failure to comply with the conditions would result in the lapse of the stay order.
