The application was made without unreasonable delay, and the appellant demonstrated willingness to provide security for the decretal sum. The respondent failed to demonstrate ability to refund the decretal sum if the appeal succeeds, thus the risk of substantial loss to the appellant was not controverted. The court exercised its discretion to grant stay of execution on condition that the appellant deposits the decretal sum in a joint interest-earning account of both counsels or provides a bank guarantee within 45 days.
