Ratio Decidendi

The court found that although the applicant claimed to have made efforts to serve the respondents personally, there was no affidavit of service or other evidence provided to substantiate these claims. The law requires that before granting leave for substituted service, the applicant must demonstrate, with evidence, that reasonable efforts at personal service have been made and have failed. In the absence of such evidence, the court is not satisfied that the threshold for granting substituted service has been met. Consequently, the application for leave to serve the respondents by substituted service was dismissed.
