Ratio Decidendi

The Tribunal found that it had already determined all the issues raised in the tenant's application in its previous ruling of 15th August 2023. Citing the functus officio doctrine as affirmed by superior courts, the Tribunal held that it could not revisit or vary its own decision, nor could it sit on appeal against itself. The Tribunal therefore lacked jurisdiction to entertain the tenant's application to set aside the previous ruling and reinstate the suit. The application was deemed incompetent, bad in law, and an abuse of court process, warranting dismissal with costs to the landlady.
