The court found that the delay of two months in filing the application for leave to appeal was not inordinate and that reasonable grounds for the delay were presented. The court exercised its discretion to enlarge time for filing the appeal. Regarding stay of execution, the court held that the applicants would suffer substantial prejudice if stay was not granted and the decretal sum was paid out and not recoverable if the appeal succeeded. The court granted stay of execution on the condition that the applicants pay part of the decretal amount (Kshs. 90,000) to the respondent within 45 days, finding this to be sufficient security.
