Legal Issues
- 1 Whether the applicant's sentence should be revised in light of the prison decongestion exercise.
- 2 Whether the applicant is suitable for probation based on the probation officer's report.
Ratio Decidendi
The court found that the applicant, having pleaded guilty and served 1½ years in custody, was a suitable candidate for probation as recommended by the probation officer. The complainant, who is also the applicant's father, expressed willingness to reconcile, and the applicant had demonstrated good behaviour in prison. In the interests of justice and in line with the objectives of the prison decongestion exercise, the court determined that the custodial sentence should be reviewed and substituted with a non-custodial probation order for one year.
Court Disposition
sentence reviewed and substituted with probation
Orders
- The applicant is released from prison and to serve a one (1) year probation sentence.
- The terms of probation are to be explained to the applicant.
