As such, there was nothing to execute, and therefore, the order was not capable of being stayed. The court found that the applicant had not demonstrated any basis for the exercise of its discretion to grant a stay, as the refusal of the prior application simply left the parties in the position they were in before the application was made. The application for stay was thus devoid of merit and was dismissed with costs to the claimant.
