Procedural Posture

Extension of Time Application / Ruling on Application for Extension of Time to File Appeal

  1. 1 Whether the applicant is entitled to extension of time to file and serve the memorandum and record of appeal out of time.
  2. 2 Whether leave to appeal to the Court of Appeal was necessary and, if so, whether it was obtained.
  3. 3 Whether the absence of leave to appeal renders the intended appeal incompetent.

Ratio Decidendi

The court held that the application for extension of time to file and serve the memorandum and record of appeal was devoid of merit because the applicant had not obtained leave to appeal to the Court of Appeal, which was a mandatory prerequisite since the High Court was not exercising its original jurisdiction. The absence of such leave rendered the intended appeal incompetent, and therefore, even if the delay were excused, the application could not succeed. The court further noted that the matter had been in court for a long time and that continuing litigation would not serve the ends of justice. Accordingly, the application was dismissed.
