Ratio Decidendi

The court found that although the Defendant's registered office and the cause of action were in Kiganjo, Nyeri, the Defendant also carried on business in Nairobi, which was not denied. Section 14 of the Civil Procedure Act therefore entitled the Plaintiff to file the suit in Nairobi. The cost of transporting witnesses to Nairobi was not so prohibitive as to justify a transfer. The suit was properly before the Chief Magistrate's Court in Milimani, Nairobi, and there was no sufficient reason to order a transfer. The application for transfer was dismissed.
