Ratio Decidendi

The court found that although the applicant did not diligently follow up on the request for certified copies of proceedings, the High Court registry was also duty bound to inform the applicant when the certified copies were ready. There was no evidence that the applicant would not have taken steps to obtain the proceedings in May 1983 if he had been informed. The court exercised its discretion under rule 4 to allow the application for extension of time, but ordered that the applicant pay the respondents' costs before instituting the appeal, to encourage diligence in following up with court registries.
