The Court found that, although the suit was filed many years after the registration of the title in the Defendant's name, the Plaintiffs' claim is properly characterized as one for recovery of trust property under a resulting trust, as they contributed to the purchase price but the land was registered in the Defendant's name. As such, the claim falls within the exception provided by Section 20(1)(b) of the Limitation of Actions Act, which exempts actions by beneficiaries to recover trust property from the ordinary limitation period.
