Ratio Decidendi

The court found that the arbitration agreement expressly required both parties to share the arbitrator's fees equally and that any outstanding fees must be paid before the award is released. The applicant provided credible evidence of payment of more than half the agreed fees, while the respondent failed to demonstrate compliance with its obligation. In the absence of any response or proof from the respondent, and given the arbitrator's right to withhold the award pending payment, the court concluded that the respondent must pay the outstanding Kshs 220,000 to enable collection of the arbitral award. The applicant was also entitled to the costs of the application.

Court Disposition

Application allowed in respect to prayer (i).

Orders

  • The respondent is ordered to pay the arbitration fees/costs of Kshs 220,000 within 60 days to enable the parties to collect the arbitral award.
  • The applicant shall have the costs of the motion, to be paid by the respondent.
