Procedural Posture

Judicial Review Application / Ruling on Leave to Apply for Mandamus

  1. 1 Whether leave should be granted to apply for judicial review orders of mandamus to compel settlement of a decree issued over twelve years ago.
  2. 2 Whether the decree is enforceable given the lapse of time under Section 4(4) of the Limitation of Actions Act.

Ratio Decidendi

The court held that the application for leave to apply for mandamus was filed fourteen years after the decree was issued, well beyond the twelve-year limitation period prescribed by Section 4(4) of the Limitation of Actions Act. Since no execution proceedings had been initiated within the twelve-year period, the decree had become stale and incapable of execution. Consequently, the court's jurisdiction to entertain the application was extinguished by operation of law, and the application was declined and struck out for want of jurisdiction.
