Ratio Decidendi

The court found that the applicant's notice of appeal was filed outside the statutory 14-day period required by Rule 77(2) of the Court of Appeal Rules, 2022. Since the notice was not validly filed, there was no competent notice of appeal on record. Without a valid notice of appeal, the application for extension of time to file and serve the record of appeal was incompetent and misconceived. The court therefore dismissed the application, holding that the absence of a valid notice of appeal is fatal to the request for extension of time.
