The appellate court found that the trial court erred by dismissing the application for reinstatement of the suit after it had already granted the same prayer ex parte. By revisiting and determining a prayer that had already been granted, the trial court acted without jurisdiction and was functus officio. The proper procedure would have been for the aggrieved party to seek review, not for the court to revisit its own decision. The appellate court also held that, once the issue of reinstatement was determined, it was not necessary for the trial court to address the remaining prayers, as they became moot.
