Ratio Decidendi

The court found that the applicants failed to provide a satisfactory explanation for the delay of over four months in seeking leave to appeal out of time. There was no evidence that the applicants contacted their previous advocate or that the current advocate was instructed within a reasonable period after judgment. The delay was deemed inordinate and unexplained. Consequently, the application for extension of time to file an appeal was dismissed. Since no appeal existed and leave to appeal out of time was not granted, the application for stay of execution pending appeal also failed. The court therefore dismissed both limbs of the application.
