The High Court determined that it lacks jurisdiction to grant leave for private prosecution or to allow a complainant to appeal against an acquittal by the Magistrates Court. The right to privately prosecute is provided for under Section 88 of the Criminal Procedure Code, but such leave must be sought from the Magistrates Court, not the High Court. Furthermore, the law only permits the Director of Public Prosecutions to appeal against acquittals, not private complainants. Since the Applicant did not privately prosecute the original case and no leave for private prosecution was granted at the trial stage, she cannot seek to appeal as a continuation of such leave.
