Ratio Decidendi

The court held that the issuance of warrants of arrest against the directors was premature and without basis, as the plaintiff's application seeking to lift the corporate veil and for their examination had not yet been heard or determined. The record did not show that the corporate veil had been lifted at any time, and therefore, there was no legal foundation for personal execution against the directors. The court vacated the warrants of arrest and directed that the plaintiff's application dated 12th October 2005 be set down for hearing, at which the directors should attend for examination as previously ordered. Costs of the application were ordered to be in the cause.
