Ratio Decidendi

The court found that the application was unopposed and that the applicant had established that the appellant had failed to pay the taxed costs following the dismissal of the appeal. The law under Order 22 Rules 4 and 5 of the Civil Procedure Rules empowers the court to send a decree for execution to another court, especially where the judgment debtor resides within that court's jurisdiction. Since the Kyuso Senior Resident Magistrates court was the court of origin and nearest to the appellant's residence, and there was no pending appeal or opposition, the court saw no reason to deny the application. The orders sought were therefore granted to facilitate execution of the taxed costs.
