The court found that the claimant's cause of action arose in August 2015 when he was verbally dismissed after acquittal. The claim was filed on 23rd April 2018, more than three years after the cause of action arose. Section 90 of the Employment Act prescribes a mandatory three-year limitation period for employment claims, which cannot be extended. As such, the claim was statute barred, and the court lacked jurisdiction to entertain it. The claim was accordingly struck out.
