The court found that the reference to Kshs. 67,500,000/- in the judgment was a clear mathematical error, as the intended midpoint between Kshs. 65,000,000/- and Kshs. 75,000,000/- is Kshs. 70,000,000/-. The error was apparent on the face of the record and did not require elaborate argument to establish. The application for review was filed promptly within one month of the judgment. The existence of an appeal did not bar the court from correcting its own error, as the grounds for review were not common to the appeal. The court therefore allowed the application and rectified the amount awarded to the plaintiff to Kshs. 70,000,000/-.
