Ratio Decidendi

The court found that the applicants failed to demonstrate an arguable appeal, as there was no prima facie evidence that the respondent failed to provide the clearance certificate before issuing the completion notice. The evidence showed that the clearance certificate and transfer were forwarded to the applicants' advocates before the notice was issued, and the applicants paid the balance of the purchase price after the notice had expired. Since both limbs under Rule 5(2)(b) must be satisfied and the first limb was not met, the application for stay of execution could not succeed. The court therefore dismissed the application for stay of execution pending appeal.
