Ratio Decidendi

The tribunal found that the parties entered into a fixed-term lease for one year commencing 1st October 2022 and expiring 30th September 2023. The lease was clear and unequivocal, and upon expiry, the tenancy relationship terminated automatically. The letters from the landlord merely notified the tenant of the impending expiry and did not constitute a termination notice as contemplated under Section 4(2) of Cap. 301. Since the tenancy was for a fixed term, no statutory termination notice was required. The tribunal further held that the existence of a previous unresolved case (BPRT Case No. 152 of 2018) was rendered moot by the new tenancy agreement and did not bar the present proceedings....
