The Court of Appeal held that its jurisdiction to entertain an application for stay of execution under Rule 5(2)(b) of the Court of Appeal Rules is dependent on the prior filing of a Notice of Appeal in accordance with Rule 75. In this case, the applicants failed to provide evidence of a filed Notice of Appeal, as neither the annexures nor the supporting affidavit contained such evidence. The purported Memorandum of Appeal was undated, unsigned, and unstamped, and thus did not satisfy the requirements. As a result, the Court found that it lacked jurisdiction to hear the application, rendering it incompetent and liable to be struck out.
