The court held that even if the period during which the application for review was pending was excluded, the subsequent delay of 18 days remained unexplained and inordinate. The court further held that once the application for review was determined, the 1st Defendant was foreclosed from appealing the same order, and the proper course would have been to appeal or seek review of the subsequent order, which was not done.
