The court held that it lacked jurisdiction to review and set aside the orders made by Nyamweya J. on the ground of lack of jurisdiction, as such a ground is not available for review under Order 45 Rule 1 of the Civil Procedure Rules but is a matter for appeal. The Bank, not being a party to the suit, lacked locus standi to seek the setting aside of consent orders. The Interested Party was properly joined to the suit, having demonstrated a legitimate interest in the suit property. Even if the court had jurisdiction, it would have reached the same conclusion as Nyamweya J. The Bank's application was also dismissed for inordinate delay and lack of merit.
