Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution and Enlargement of Time to Appeal

  1. 1 Whether the appellant is entitled to a stay of execution of the lower court's judgment pending determination of its application and/or appeal.
  2. 2 Whether the time for filing the appeal should be enlarged and the memorandum of appeal deemed properly filed.
  3. 3 Whether the appellant was denied notice of judgment delivery, affecting its right to appeal.

Ratio Decidendi

The court found that the appellant was not given notice of the date of judgment delivery, which prejudiced its right to appeal. The court exercised its discretion to enlarge the time for filing the appeal, deeming the memorandum of appeal properly filed. On the issue of stay of execution, the court held that since the appellant conceded that Kshs.750,000 was reasonable compensation, it should pay 90% of that amount (Kshs.675,000) to the respondent as a condition for stay. The stay of execution would remain in force until the appeal is heard and determined, provided the appellant complies with the payment condition. Each party was ordered to bear its own costs as both had partial success.

Court Disposition

Application for stay of execution and enlargement of time allowed on conditions.

Orders

  • Stay of execution of the lower court's judgment granted on condition that the appellant pays Kshs.675,000 to the respondent within 30 days; failing which execution to issue forthwith.
  • Time for filing the appeal is enlarged; the memorandum of appeal is deemed properly filed.
