Furthermore, a claim for adverse possession cannot be sustained where the applicant alleges the title was obtained fraudulently. However, the court accepted that the land was held in trust for the family, and the applicant is entitled to the portion she occupies on the subdivided parcel Kisumu/Dago/4424.
