The court found that the registration of land parcel Kiteta/Kakuswi/399 in the name of the Defendant's father was a clear mistake, as evidenced by the sale agreement and corroborated by proceedings before the District Land Registrar. Both original parties acknowledged the error and intended to rectify it, but died before doing so. The Plaintiff and his family have always occupied parcel 399, while the Defendant occupies parcel 352, which was the subject of the sale.
