The court found that the preliminary objection on limitation of actions was not merited because the Plaintiff's cause of action was based on alleged fraud, and under section 26 of the Limitation of Actions Act, time runs from the date of discovery of the fraud. The alleged fraudulent cancellation occurred on 4th October 2016, and the suit was filed within three years, thus not time-barred. The objection on res judicata was also dismissed; prior suits (ELC 1400 of 2013 and Misc 6 of 2017) did not finally determine the issues of fraud and cancellation of title on their merits.
