Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the plea entered by the appellant was unequivocal and in a language he understood.
  2. 2 Whether the sentence imposed by the trial court was manifestly excessive.

Ratio Decidendi

The court found that the appellant understood Kiswahili, as evidenced by his responses during plea, mitigation, and the probation officer's interview. There was no indication of a language barrier at any stage of the proceedings. The plea was therefore unequivocal and properly entered. However, upon review of the sentence, the court held that the 10-year imprisonment imposed by the trial court was manifestly excessive given the circumstances and the extent of injuries as shown in the P3 form. Exercising its powers under Section 354 of the Criminal Procedure Code, the High Court revised the sentence to 2 years imprisonment.
