The Tribunal found that the Applicant failed to demonstrate the existence of a landlord/tenant relationship with the Respondent. There was no evidence of rent payment by the Applicant to the Respondent, nor any indication that the Respondent consented to or acquiesced in the Applicant's occupation of the premises. The only evidence was that the Applicant was sublet the premises by a third party, Eva Morisiet, without the Respondent's consent. The Applicant did not challenge or deny these assertions.
