The conviction for trafficking by selling could not stand because the prosecution failed to prove that the appellant was engaged in selling the narcotic drugs as alleged in the charge. The evidence only established that the appellant was found in possession of the drugs, but no sale or attempt to sell was witnessed or proved. The trial magistrate erred in inferring selling from the mere presence of Kshs.1,200/- in the appellant's house, as there was no evidence linking the money to any drug transaction. Furthermore, the appellant's defence, corroborated by her landlady, was not given due weight. As the charge and particulars were not supported by the evidence, the conviction was unsafe...
