The court found that the insurance policy covered the Plaintiff's employee (the deceased turn-boy) as he was travelling in the vehicle in pursuance of his contract of employment, and thus the Defendant was obligated to indemnify the Plaintiff and defend Civil Suit No. 89 of 2014. The Defendant's reliance on an assessment report to pay less than the insured value was rejected because the report was not produced by an expert witness and could not be relied upon as evidence of the vehicle's value.
