Section 123(3) of the Criminal Procedure Code, as amended to prohibit bail for offences such as robbery with violence, is inconsistent with sections 72(5) and 60(1) of the Constitution of Kenya. The Constitution provides that release on bail is mandatory in certain circumstances for all offences, and the High Court's jurisdiction cannot be curtailed by ordinary legislation unless such limitation is expressly provided for in the Constitution. Therefore, section 123(3) is void to the extent of its inconsistency and must be read as if the prohibitive words are deleted.
