Ratio Decidendi

The court found that the only property comprising the estate was L.R.No. Isukha/Murhanda/845, measuring approximately 1.4 hectares and still registered in the name of the deceased. Guided by Section 38 of the Law of Succession Act, the court held that the estate should be divided equally between the two children of the deceased: Margaret Masitsa Musonye and Jackson Mbiya Mukoto (now deceased), whose share would devolve to his widow, Marble Khasandi Muchesia. The court directed Marble to apply for confirmation of grant within ninety days, failing which Margaret could proceed. Each party was ordered to bear their own costs.

Orders

  • The estate, being L.R.No. Isukha/Murhanda/845, shall be divided equally between Margaret Masitsa Musonye and the estate of Jackson Mbiya Mukoto (represented by Marble Khasandi Muchesia).
  • Marble Khasandi Muchesia shall, within ninety (90) days, file summons for Confirmation of the Grant; if she fails, Margaret Masitsa Musonye may proceed to do so.
