There was no written or oral will, nor evidence of transfer or delivery of the property to the 2nd protestor. The mere occupation of the property and construction of extensions did not amount to a completed gift. The property remained part of the free estate of the deceased and, in accordance with Section 35 of the Law of Succession Act, should be held by the applicant in trust for all children, with the applicant enjoying a life interest.
