The court found that the issue of whether the defendants should be allowed to file their defence out of time had already been determined on 6th February, 2019, when the court declined their oral application and granted leave to appeal. The defendants did not pursue an appeal or obtain a stay of proceedings. The present application, seeking the same relief, was therefore res judicata and an abuse of the court process. The court emphasized that it cannot re-open issues already determined on merit, and that the defendants had been indolent in their conduct. Consequently, the application to set aside the interlocutory judgment and for leave to file defence out of time was dismissed with costs.
